As an employee in New York State, you are protected from sexual orientation discrimination. Denial of health benefits for your same-sex partner because your company plan only covers married heterosexuals, constant jokes and comments from co-workers about your sexual activity and mannerisms, and being passed over for promotions for which you are qualified because you’re gay, are all examples of sexual orientation discrimination. You don’t have to put up with this type of unfair or unequal treatment caused by your employer’s bias. At the New York law firm of Castronovo & McKinney, our New York Sexual Orientation Discrimination Lawyers vigorously advocate for your rights in these cases and our experienced NYC Discrimination Attorneys will fight for you.
About Sexual Orientation Discrimination In New York
The Sexual Orientation Non-Discrimination Act is New York State law prohibiting discrimination against individuals based on their sexual orientation. The law defines this as homosexuality, bisexuality, asexuality or heterosexuality, and makes no distinction between whether one’s orientation is actual or just perceived. Transgender persons are included in this protected class. Religious organizations and institutions are partially exempt. If you have experienced sexual orientation discrimination at work, you may either file a charge with your local human rights agency or the state division within 12 months of the unlawful activity, or file a complaint in civil court within three years of the discriminatory treatment. In addition to one of those options, you may file a complaint with the Civil Rights Bureau of the NY State Attorney General’s Office.
Possible relief for sexual orientation employment discrimination includes the following:
- Compensatory damages for pain and suffering
- Lost wages
- Monetary value of lost benefits
- Securing employment
- Job reinstatement
- Promotion
- Unsegregated full and equal facilities and accommodations
Punitive damages and attorney fees are not available under SONDA.
